The ICBA Compliance Deskbook has been enhanced to include the following:

Overview

Recently, IoT devices have been used to create large-scale botnets—networks of devices infected with self-propagating malware—that can execute crippling distributed denial-of-service (DDoS) attacks. IoT devices are particularly susceptible to malware, so protecting these devices and connected hardware is critical to protect systems and networks.

Lending:

Servicemember Civil Relief Act (IV-17) - On March 31, 2016, President Obama signed into law the Foreclosure Relief and Extension for Servicemembers Act of 2015 (Pub. L. 114-142). This act extended again, on a temporary basis, the duration of coverage applicable to the section 303 protections for obligations described above from nine months to one year after a servicemember’s military service. This extension ends December 31, 2017.
Effective Date: January 1, 2016

Truth In Lending (IV-3) - On June 27, 2016, the Bureau of Consumer Financial Protection (CFPB) issued a final rule amending the regulatory text and official interpretations for Regulation Z, which implements the Truth in Lending Act (TILA). This revision addresses the penalty safe harbor fee amount in section 1026.52.
Effective Date: June 27, 2016

SQL Server 2005 extended support ends on April 12, 2016 - Monday, February 29, 2016
If you are still on versions earlier than Windows Server 2012 R2 and SQL Server 2014, now is the time to consider upgrading to take advantage of ground-breaking improvements in performance. Support for the following versions is ending soon, which will mean no more security updates, higher maintenance costs and potential compliance concerns:
◾Windows Server 2003 extended support ends on July 14, 2015
◾SQL Server 2005 extended support ends on April 12, 2016
◾SQL Server 2008 mainstream support ended on July 8, 2014 and is in extended support until July 9, 2019

While these dates may seem distant, now is the time to develop a migration plan for your applications and workloads that currently rely on Windows Server 2003 and SQL Server 2005 to Windows Server 2012 R2 and SQL Server 2014 or Microsoft Azure SQL Database.


There is tremendous value available in upgrading to the latest version of SQL Server including:
◾Performance gains. Benchmarks show SQL Server 2014 performs 13x faster compared to SQL Server 2005* and 5.5x faster compared to SQL Server 2008**.

The Consolidated Reports of Condition and Income (Call Report) for the December 31, 2015, report date must be received by Saturday, January 30, 2016. Certain institutions with foreign offices have an additional five calendar days to submit their reports. In addition, the Call Report revisions proposed by the banking agencies in September 2015 have been deferred to no earlier than September 30, 2016.

Statement of Applicability to Institutions With Total Assets Under $1 Billion: This Financial Institution Letter applies to all FDIC-supervised banks and savings associations, including community institutions.

CFPB Finalizes Two-Month Extension of Know Before You Owe Effective Date - Tuesday, July 21, 2015

WASHINGTON, D.C. – The Consumer Financial Protection Bureau (CFPB) today issued a final rule moving the effective date of the Know Before You Owe mortgage disclosure rule, also called the TILA-RESPA Integrated Disclosures rule, to October 3, 2015. The rule requires easier-to-use mortgage disclosure forms that clearly lay out the terms of a mortgage for a homebuyer. The Bureau issued the change to correct an administrative error that would have delayed the effective date of the rule by at least two weeks, until August 15, at the earliest.

CFPB Proposes Two-Month Extension of Know Before You Owe Mortgage Rule



Proposal Open for Public Comment Until July 7th

WASHINGTON, D.C. – The Consumer Financial Protection Bureau (CFPB) today issued a proposed amendment to the Know Before You Owe mortgage disclosure rule, which proposes to move the rule’s effective date to October 3, 2015. The rule, also called the TILA-RESPA Integrated Disclosure rule, requires easier-to-use mortgage disclosure forms that clearly lay out the terms of a mortgage for a homebuyer. The Bureau is issuing the proposal to correct an administrative error that would have delayed the effective date of the rule by at least two weeks, until August 15 at the earliest.

The CFPB is proposing a new effective date of Saturday, October 3. The Bureau believes that moving the effective date may benefit both industry and consumers with a smoother transition to the new rules. The Bureau further believes that scheduling the effective date on a Saturday may facilitate implementation by giving industry time over the weekend to launch new systems configurations and to test systems. A Saturday launch is also consistent with existing industry plans tied to the original effective date of Saturday, August 1.

The proposal will be open for public comment until July 7.

“The CFPB will be issuing a proposed amendment to delay the effective date of the Know Before You Owe rule until October 1, 2015. We made this decision to correct an administrative error that we just discovered in meeting the requirements under federal law, which would have delayed the effective date of the rule by two weeks. We further believe that the additional time included in the proposed effective date would better accommodate the interests of the many consumers and providers whose families will be busy with the transition to the new school year at that time.” read more ...

Lending:

Regulation Z (IV-3) - December 31, 2013, the CFPB published rules and forms that combine certain disclosures that consumer receive in connection with applying for and closing on a mortgage loan under the Real Estate Settlement Procedures Act (RESPA) and Truth in Lending Act. Consistent with this requirements, the CFPB is amending Regulation X (RESPA) and Regulation Z (Truth in Lending) to establish new disclosure requirements and forms in Regulation Z for most closed end consumer credit transactions secured by real property. The combining of the existing disclosure requirements and implementing new requirements was imposed by the Dodd-Frank Act.

The CFPB made revisions to the integrated disclosure final rule in February 2015. These revisions are included and annotated.

Effective date: August 1, 2015


Real Estate Settlement Procedures Act (RESPA) – Regulation X (IV-9) - December 31, 2013, the CFPB published rules and forms that combine certain disclosures that consumer receive in connection with applying for and closing on a mortgage loan under the Real Estate Settlement Procedures Act (RESPA) and Truth in Lending Act. Servicemember Civil Relief Act (IV-17) - On December 18, 2014, the President signed into law the Foreclosure Relief and Extension for Servicemembers Act of 2014 (Public Law 113-286). The law provides a temporary extension of extended period of protections for members of uniformed services relating to mortgages, mortgage foreclosure, and evictions.

Regulation Z (IV-3) - On December 29, 2014, the Bureau amended the official commentary that interprets the requirements of the Bureau’s Regulation Z (Truth in Lending) to reflect a change in the asset size threshold for certain creditors to qualify for an exemption to the requirement to establish an escrow account for a higher-priced mortgage loan based on the annual percentage change in the average of the Consumer Price Index for Urban Wage Earners and Clerical Workers (CPI–W) for the 12-month period ending in November. (See background and changes for details.)
